Circuit Court Clerk's Office in Leesburg

The Loudoun County Circuit Court Clerk is Hon. Gary M. Clemens. The clerk's office is located at 18 E. Market St., 3rd Floor, Leesburg, VA 20178 (mailing address: P.O. Box 550, Leesburg, VA 20178). The office phone is (703) 777-0270, fax (703) 777-0376, and the general email is clerk@loudoun.gov. Office hours are 8:00 AM to 4:00 PM, Monday through Friday. Financial transactions, including recording fees and taxes, must be completed during those hours.

The Loudoun County Circuit Court is part of Virginia's 20th Judicial Circuit. Judges currently serving on the court include Chief Judge Hon. Douglas L. Fleming Jr., along with Hon. James P. Fisher, Hon. James E. Plowman Jr., Hon. Stephen E. Sincavage, and Hon. Matthew P. Snow. Court terms begin on the 2nd Monday in February, April, June, August, and December, and on the 3rd Monday in October.

Visitors should be aware that camera phones are not permitted in the courthouse without a special bar pass. All visitors are subject to security screening when entering the building. Plan ahead if you are bringing documents to file or need to search records in person.

How to Record a Deed in Loudoun County

Loudoun County accepts deed recordings in person, by mail, and through eRecording. In-person filings are accepted at the clerk's counter during regular business hours. For mail submissions, use the P.O. Box address above and include a self-addressed stamped envelope for return of originals. For eRecording, contact the clerk's office by email at clerk@loudoun.gov or visit loudoun.gov/clerk for information on approved eRecording providers.

The original deed must be submitted with original signatures and notarization. The document must comply with Virginia Code § 55.1-300: pages must be numbered, and the grantor's and grantee's surnames must appear in capital letters or be underscored in the first clause. The tax map parcel ID must appear on the first page per § 17.1-252. Social security numbers must be removed before filing under § 17.1-227. A cover sheet is required under § 17.1-227.1.

The Virginia SRA system provides free grantor and grantee index searches for Loudoun County. You can look up recorded instruments by party name and retrieve the document type, recording date, and deed book and page number. Full document images may require a subscription. Loudoun is one of Virginia's most active real estate markets. Documents Recorded in Loudoun County

All instruments affecting real property in Loudoun County must be filed with the Circuit Court Clerk to be effective against third parties. Common filings include warranty deeds, quitclaim deeds, deeds of trust securing loans, and certificates of satisfaction when mortgages are paid off. Subdivision plats and survey maps must be recorded before individual lots can be conveyed.

Easement deeds, access agreements, and utility easements are part of the land record. Powers of attorney for real estate transactions, lis pendens notices, and mechanic's liens are also filed at the clerk's office. UCC fixture filings and condominium declarations are recorded here as well.

Under Virginia Code § 55.1-407, an unrecorded deed is void against a subsequent bona fide purchaser who records first. Loudoun County's race-notice recording system means the first to record with proper notice has priority. Record promptly after any real estate closing to protect your ownership.

Recording Fees and Taxes

Loudoun County follows the statewide fee schedule under Virginia Code § 17.1-275. Documents of 10 pages or fewer cost $18 to record. Those running 11 to 30 pages cost $32. Documents over 30 pages cost $52. A portion of each fee is allocated to the Library of Virginia for records preservation.

The state recordation tax applies under Virginia Code § 58.1-801. The rate is 25 cents per $100 of the purchase price or fair market value, whichever is higher. Certain transfers may be exempt under § 58.1-811, such as transfers between family members or to government entities. Copies of recorded documents cost $0.50 per page.
